The use of EAWs for prosecution (at the pre-trial stage) has steadily increased since 2005 despite the availability of alternatives measures. Over the past year, the partners of the EU-funded project titled EAW-Alt, coordinated by Fair Trials, have conducted research on the use of alternative measures and recourse to pre-trial detention in EU cross-border cooperation, in Austria, Belgium, Greece, Ireland and Luxembourg. The aim of the research is to understand the obstacles to the use of alternative measures in cross-border proceedings.


After a presentation of the key findings of our research, this webinar will bring together practitioners to discuss the resistance towards the use of alternatives to EAWs for prosecution, and identify promising practices in the context of the current digitalisation of justice agenda. In a second panel, we will focus on the overreliance on detention at the pre-trial stage in cross-border proceedings where the risk of absconding is nearly automatically presumed for non-nationals or non-residents.
